1. About Us & Acceptance of Terms

1.1 Who We Are

Escortify is a classified advertising platform that allows independent third-party users to post adult-related and dating advertisements. The permitted advertisements are dating advertisements, erotic dating advertisements, and advertisements for adult establishments. All advertisements on the website are created and published solely by independent third-party users. Escortify operates solely as a hosting platform for user-generated content in the form of advertisements. We have no affiliation with advertisers and accept no liability for the content of their advertisements or their conduct.

1.2 Acceptance

By accessing or using Escortify.co.nz (the "Site" or "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Service.

1.3 Platform Role

Escortify is a hosting platform for user-generated content. We do not produce, edit, endorse, or verify the content of advertisements. All content is created and posted by independent third-party users who are solely responsible for the legality, accuracy, and correctness of their content. Escortify does not arrange, facilitate, or manage the services advertised by users. Escortify does not have any connection with the advertisers or is not responsible for their behaviour or the content of the advertisements.

We reserve the right to remove, block, or delete any content that violates these Terms.

2. Eligibility

2.1 Age Requirement

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 or older.

2.2 Advertiser Residency Requirement

If you wish to post an advertisement for adult services, you must be a New Zealand citizen or resident as required by Section 19 of the Prostitution Reform Act 2003 (NZ).

By posting an advertisement, you represent and warrant that:

You are at least 18 years of age.
You are a New Zealand citizen or permanent resident for advertisements involving commercial sexual services.
The advertisement is for your own services, or you have the verified, written consent of the person whose services are advertised.
All content you post is lawful and complies with these Terms.

2.3 Verification

Escortify may require you to verify your identity, age, and/or residency status at any time. Verification methods include:

Phone verification at sign-up.
Automated age verification via Yoti, a secure, encrypted, EU-based identity verification service.
Secure document upload via our encrypted verification portal.

3. Third-Party Content, Sites & Services

The Service may contain features and functionalities that link to or provide access to third-party content, including websites, directories, networks, databases, applications, software, products, or services that are completely independent of Escortify.

Your interactions with organisations and/or individuals found on or through the Service, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organisations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties.

You agree that Escortify shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between participants on this site, or between users and any third party, you understand and agree that Escortify is under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release Escortify, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or our Service.

4. Prohibited Content & Conduct

You agree not to post, transmit, or make available any content that:

4.1 Criminal & Exploitative Content

(a) Contains, depicts, or relates to any person under 18 years of age. We will report suspected involvement of minors to NZ Police and may take legal action.
(b) Relates to human trafficking, pimping, coercion, or any form of exploitation. See Section 11 (Anti-Trafficking & Safety).
(c) Constitutes or promotes illegal prostitution under the Prostitution Reform Act 2003.
(d) Advertises illegal services including unprotected sexual services or refers to "natural" or unprotected services in any way.
(e) Depicts bestiality, non-consensual acts, sadistic or masochistic abuse, or any content that is objectionable under the Films, Videos, and Publications Classification Act 1993 (NZ).
(f) Relates to controlled substances, illegal weapons, or other prohibited items.

4.2 Harmful & Deceptive Content

(g) Is false, deceptive, misleading, or deceitful.
(h) Is defamatory, threatening, abusive, harassing, or invasive of another's privacy.
(i) Discriminates against individuals or groups based on race, gender, sexual orientation, religion, ethnicity, nationality, disability, or any other protected characteristic.
(j) Uses vulgar, offensive, or aggressive language inconsistent with professional standards.
(k) Encourages conduct that could constitute a criminal offence or give rise to civil liability.

4.3 Intellectual Property & Privacy

(l) Infringes any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right.
(m) Includes personal or identifying information about another person without their explicit consent.
(n) Uses copyrighted images or content without authorization.
(o) Contains images depicting obscenity, as determined at Escortify's sole discretion. We reserve the right to remove any images that do not meet our content standards, and repeat offenders may face account suspension or termination.

4.4 Platform Integrity

(p) Is posted from outside New Zealand or through a VPN for the purpose of concealing your location when creating an account or posting advertisements. Browsing the site via VPN is permitted. Advertisements posted using a VPN may be automatically deleted and the associated account blocked.
(q) Contains links to websites hosting illegal content.
(r) Involves fraudulent, manipulative, or illegal activity, including credit card fraud.
(s) Attempts to collect, aggregate, scrape, or extract data from the Service without authorization.

4.5 Content Moderation

We reserve the right to remove any content that violates these Terms, applicable law, or payment card scheme rules and policies. Content decisions are made in a timely, objective, and non-arbitrary manner. See Section 9 for our content moderation process. Escortify reserves the right to take legal action against any user who violates these Terms or applicable law.

5. Content You Post

5.1 Your Responsibility

You are solely responsible for all content you post on the Service. You represent that you have all necessary rights and permissions to post such content and that it complies with all applicable laws.

5.2 License to Escortify

By posting content on the Service, you grant Escortify a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content solely for the purpose of operating and promoting the Service. This license is:

Revocable: It terminates when you delete the content or your account, subject to reasonable technical timeframes for removal from active systems (up to 30 days) and backups (up to 90 days).
Limited: We will not use your content for purposes unrelated to the operation of the Service.
Subject to your data protection rights: You retain the right to request erasure of your personal data under applicable law. See Section 7.

5.3 Third-Party Content

The Service may contain links to third-party websites and services that are independent of Escortify. We make no representations about third-party content. Your interactions with third parties found through the Service are solely between you and those parties.

6. Paid Services

6.1 Fees

We charge fees for posting advertisements and for premium features, including but not limited to visibility boosts, featured placements, and credits. All prices are displayed during checkout and on our pricing page. All prices are inclusive of applicable taxes, including GST. Escortify is registered for GST in New Zealand (GST number: 143-971-309).

6.2 Payment Processing

Payments are processed by a third-party payment gateway. Escortify does not see, store, or process your credit card number, security code, or full card details. If you save card data for future payments, that data is stored and handled by Centrobill. To delete saved card data, contact us at support at escortify.co.nz.

6.3 Refunds

Content removed for Terms violations: Non-refundable.
Service not delivered or not as described: You are entitled to a remedy under the NZ Consumer Guarantees Act 1993 and EU consumer protection law. This may include re-performance, a price reduction, or a refund.
All other cases: Refund requests are considered on a case-by-case basis. Submit requests to support at escortify.co.nz. We aim to respond within 5 business days and process approved refunds within 14 days to the original payment method.

6.4 Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any rights you have under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986 to the extent such exclusion is prohibited by law. Where our services are provided to you as a consumer, the guarantees under those Acts apply regardless of any other provision in these Terms.

7. Privacy & Data Protection

7.1 Data Controller

AdFlare Ltd is the data controller for personal data processed through the Service. We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and the New Zealand Privacy Act 2020.

7.2 Privacy Policy

Our processing of your personal data is described in our separate Privacy Policy, which forms part of these Terms. The Privacy Policy details:

What data we collect and why.
Lawful bases for processing.
Your rights: access, erasure, portability, rectification, restriction, and objection.
Data retention periods.
International data transfers.
Cookie policy.
Breach notification procedures.
How to exercise your rights or make a complaint.

7.3 Data We May Disclose

We may preserve or disclose your content and information, including email addresses, IP addresses, timestamps, and other user information, when required by law or in the good faith belief that disclosure is reasonably necessary to:

Comply with legal process or government requests.
Enforce these Terms.
Respond to claims of rights violations.
Protect the safety of Escortify, our users, or the public.
Cooperate with law enforcement in cases involving suspected criminal activity.

Your IP address is recorded when you post content. If you post illegal content, your IP address and all associated account information will be forwarded to NZ Police and relevant law enforcement authorities. You may be held criminally liable for any illegal content posted under your account.

7.4 Right to Erasure

You may request deletion of your account and personal data at any time. Upon receiving a valid erasure request, we will delete your personal data within 30 days from active systems and within 90 days from backups, unless retention is required by law, for example financial records or law-enforcement preservation orders.

8. Intellectual Property & Copyright

8.1 Platform Intellectual Property

The Service, including its design, code, logos, and compilation of content, is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, reverse engineer, or create derivative works from the Service without our written consent.

8.2 Notice-and-Takedown Procedure

If you believe your intellectual property rights have been infringed on the Service, submit a notice to support at escortify.co.nz containing:

(a) Identification of the copyrighted work or intellectual property claimed to be infringed.
(b) Identification of the material on the Site that you claim is infringing, with sufficient detail for us to locate it, including the URL.
(c) Your name, address, telephone number, and email address.
(d) A statement that you have a good faith belief that the disputed use is not authorized by the rights owner, its agent, or the law.
(e) A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the rights owner or authorized to act on their behalf.

8.3 Processing Timeline

Illegal content, including CSAM and trafficking: Removed within 24 hours of a verified report.
Copyright or IP infringement: Reviewed within 48 hours and removed within 72 hours if valid.
Other content reports: Reviewed within 72 hours.

8.4 Counter-Notice

If your content was removed and you believe it was removed in error, you may submit a counter-notice with: identification of the removed content and its former location, a statement under penalty of perjury that you believe the removal was a mistake, and your name, address, and consent to jurisdiction. We will forward the counter-notice to the original complainant and may restore the content after 10 business days unless the complainant initiates legal proceedings.

8.5 Repeat Infringers

We will terminate accounts of users who are repeat infringers.

9. Content Moderation & Appeals

9.1 Moderation Process

We moderate content to enforce these Terms and comply with applicable law. Moderation may be carried out through manual review and automated tools.

9.2 Actions We May Take

We may remove content, issue warnings, temporarily suspend accounts, or permanently terminate accounts for violations.

9.3 Notification

When we remove content or restrict your account, we will notify you with:

The specific content or action affected.
The reason for the decision, citing the relevant Term or law.
Information about how to appeal.

9.4 Appeal Process

You may appeal any content moderation decision within 30 days by emailing support at escortify.co.nz with:

Your account details.
The content or action you are appealing.
Why you believe the decision was incorrect.

Appeals are reviewed by a qualified staff member who was not involved in the original decision. We aim to resolve appeals within 10 business days.

9.5 Out-of-Court Dispute Resolution

If you are unsatisfied with the outcome of an appeal, you may refer the matter to an out-of-court dispute settlement body. EU users may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

10. Reporting & Complaints

10.1 Reporting Content

To report a specific advertisement for violations, click the Report button on the profile page. Please include as many details as possible.

10.2 General Complaints

For complaints not related to a specific advertisement, email support at escortify.co.nz.

10.3 Reporting Suspected Trafficking or Exploitation

If you suspect human trafficking, exploitation, or involvement of minors, report it immediately:

On-site: Use the Report button and select suspected trafficking or exploitation.
Email: support at escortify.co.nz.
NZ Police: Call 111 (emergency) or 105 (non-emergency).
Crimestoppers NZ: 0800 555 111.

11. Anti-Trafficking & Safety

11.1 Our Commitment

Escortify has zero tolerance for human trafficking, exploitation, and the involvement of minors. We are committed to making our platform as safe as possible and cooperating fully with law enforcement.

11.2 Measures We Take

Age and identity verification for all advertisers.
Phone number verification to detect patterns of control.
Monitoring for trafficking indicators including multiple profiles from the same device, IP, or phone; identical ad text across profiles; language suggesting third-party control; and underage appearance in photos.
Dedicated safety reporting channel at safety at escortify.co.nz.
Data preservation when a trafficking report is made so relevant data is preserved for law enforcement.
Staff training on recognizing trafficking indicators.

11.3 Cooperation with Authorities

We cooperate with NZ Police, Immigration New Zealand, INTERPOL, and relevant agencies. When we identify or receive a credible report of suspected trafficking or involvement of minors, we will:

Immediately remove the content.
Preserve all associated data.
Report to NZ Police and any other relevant authority.
Provide requested information to law enforcement in accordance with applicable legal process.

11.4 Advertiser Obligations

By posting an advertisement, you confirm that:

You are the person depicted in the advertisement, or you have that person's verified written consent.
No person depicted is under 18 years of age.
No person depicted is being coerced, trafficked, or exploited.
You take full responsibility for all content posted under your account. You may not avoid responsibility by claiming that content was posted on behalf of, or at the request of, another person.

12. Limitations on Service

We may establish limits on the use of the Service, including the number, size, and retention period of postings. We reserve the right to modify or discontinue the Service at any time with reasonable notice. We are not liable for deletion or failure to store content.

13. Access & Restrictions

We grant you a limited, revocable, non-exclusive license to access the Service for personal use. This license does not include collection, aggregation, scraping, or automated extraction of data, except for search engines and non-commercial archives that comply with our robots.txt file and use stable, identifiable agents.

14. Account Termination

14.1 Our Rights

We may suspend or terminate your account for any reason, including violation of these Terms. Where possible, we will provide notice and reasons before or at the time of termination.

14.2 Effect of Termination

Upon termination:

Your content will be removed from the Service.
If you have unused prepaid credits or services, you may request a pro-rata refund for unused portions, except where termination is due to Terms violations.
Your personal data will be handled in accordance with our Privacy Policy and applicable data protection law.

14.3 Survival

Sections relating to liability, intellectual property, dispute resolution, and data protection survive termination.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

This disclaimer does not affect your statutory rights under the NZ Consumer Guarantees Act 1993 or EU consumer protection law, which cannot be excluded.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ESCORTIFY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

17. Governing Law & Disputes

17.1 Governing Law

These Terms are governed by the laws of the Estonia without regard to conflict of law provisions. Mandatory consumer protection laws of New Zealand apply to NZ-based users to the extent required by NZ law.

17.2 Jurisdiction

NZ consumers may bring claims in the courts of New Zealand in accordance with NZ consumer protection law.
EU consumers may bring claims in the courts of their EU member state of residence in accordance with EU Regulation 1215/2012.

17.3 Alternative Dispute Resolution

We encourage resolving disputes through our internal appeal process first.

18. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may terminate your account before the effective date.

19. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, power failures, internet or telecommunications failures, cyber attacks, or failures of third-party services, including payment processors and verification providers. We will notify users of such events and resume normal service as soon as practicable.

20. General Provisions

20.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Escortify.

20.2 Severability

If any provision is found to be invalid or unenforceable, the remaining provisions continue in full force. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

20.3 No Waiver

Our failure to enforce any right or provision does not waive that right or provision.

20.4 Assignment

We may assign our rights and obligations under these Terms. You may not assign yours without our written consent.
